The stokes interview is actually the term used to refer to an additional interview administered by the immigration service centers when they feel that a more intensive interviewing process is necessary to determine the validity of the marriage. A couple will typically have one interview and at that interview if the examiner feels the case is legit he/she will approve it. If the examiner is concerned about the validity of the marriage, he/she will schedule a “stokes” interview. A few other clarifications – couples do not need to remain married before the expiration of the conditional green card. However, if they divorce there will be a higher level of scrutiny on the validity of hte marriage when the foreign individual is applying to remove the conditional nature of his/her green card. Lastly, any immigration benefit obtained through fraud can easily be taken away anytime down the road.
