Madonna Adoption Attempt Denied Over Residency Requirement

April 3, 2009

(ChattahBox) — In a somewhat surprising ruling, but consistent with their law, a Malawi court has denied Madonna’s attempt to adopt a 3-year-old girl Chifundo James, whose mother died shortly after her birth. judge Esmie Chondo said in a ruling following a closed-door hearing on Friday: “I must have to decline to grant the application to Madonna.” . Children’s advocacy groups have accused Madonna of abusing her immense wealth and influence to circumvent Malawian law. However court sources say Madonna’s adoption attempt for her second child from the southern African nation was denied because of the residency rule. The residency requirement for prospective parents is 18 to 24 months in Malawi.    In the ruling, read out outside the court, the judge explained that ruling in Madonna’s favor might have a negative impact on adopted children’s human rights:

“By removing the very safeguard that is supposed to protect our children, the courts by their pronouncements could actually facilitate trafficking of children by some unscrupulous individuals,” she said.

When Madonna and her ex Guy Ritchie’s adopted child David Banda, 3, in 2006, the residency rule was finally waived and finalized last year. She reportedly considered Chifundo for adoption during that same visit and has remained in touch with the child’s guardians. The girl’s name means “Mercy” in the local language.
