Mark Papermaster was set to take over to run the Apple division in control of the iPod and iPhone.

IBM sued Papermaster though as he had signed a no-compete clause at the end of his contract.

U.S. District Court Judge Kenneth Karas ruled that Papermaster now has to “immediately crease his employment with Apple Inc.”

This came after IBM sued Papermaster to block him from working for Apple.

There is a one-year exclusivity contract he will have to wait out on before he can join Apple.
