Court rules John Ashcroft can be sued over post-9/11 policy

(ChattahBox) — A federal appeals court has ruled that former Attorney General John Ashcroft can be held liable for violating the constitutional rights of people wrongfully detained after Sept. 11, 2001. A three-judge panel of the 9th U.S. Circuit Court of Appeals ruled that John Ashcroft can be held legally responsible for material witnesses wrongfully detained after the 9/11 attacks. The ruling, a stinging rebuke to the Bush administration’s post-Sept. 11 detention policies, is the result of a 2005 lawsuit filed by Abdullah Al-Kidd, a U.S. citizen and convert to Islam who was detained for two weeks after Sept. 11. Al-Kidd and former University of Idaho student, spent “16 days in detention in three states in 2003, some of it shackled hand and foot. That was followed by 14 months under court supervision.” Prior to his resignation in 2004, Ashcroft came under scrutiny for his role in the Bush administration detention policy and narrowly avoided prosecution when the Supreme Court ruled that he could not be held liable for detainee abuse earlier this year. When handing down today’s verdict, the judges said they also didn’t intend to dampen the ardor of prosecutors as they carried out their duties, and said they were mindful of the pressures face by the attorney general. But, they said, even qualified immunity doesn’t allow the attorney general to carry out national security functions completely free from any personal liability concerns.  The judges described the government’s treatment of witnesses as “repugnant to the Constitution and a painful reminder of some of the most ignominious chapters of our national history.”
