Elizabeth Smart Kidnapper Ruled ‘Competent’ For Trial

March 1, 2010

Utah (ChattahBox) – Brian David Mitchell, accused kidnapper of Elizabeth Smart, has been ruled fit to stand trial by a federal court.

Mitchell allegedly kidnapped Smart at knife point from her bedroom is Salt Lake City, held her for nine months, raped her daily, and gave her drugs.

The wandering handyman and self proclaimed ‘prophet’ had told her she was his polygamist wife.

His wife, Wanda Eileen Barzee, is accused of aiding him in the imprisonment and sexual abuse of Smart, 14 at the time of her ordeal.

Carlie Christensen, acting U.S. attorney in the case, released the following statement about the verdict:

“Elizabeth Smart, her family and this community have waited many years for resolution of this case. While we have great respect for the state court efforts in this case, we believe that the additional in-depth testimony of both fact and expert witnesses presented to Judge Kimball in the federal competency proceedings was instrumental in his decision-making process. Many of these fact and expert witnesses testified for the first time during the federal competency hearing.”
