GOP Bill: Treats Women Having Miscarriages as Criminals
February 22, 2011
(ChattahBox Political News)—This is just vile. The recent legislative antics of far-ring fringe state lawmakers provide plenty of fodder for entertainment purposes for those of us who are sane. But the Republicans’ war on a woman’s reproductive rights is getting downright scary. Georgia state Rep. Bobby Franklin (R), a radical fundamentalist Christian from Marietta, who vehemently opposes “Godless government,” wants to investigate women suffering from miscarriages as criminals for committing “prenatal murder.” Franklin’s prenatal murder bill is one of the most disgusting anti-women measures to see the light of day, since the Republicans became emboldened after November’s electoral gains.
Franklin’s House Bill 1 is an incoherent and odious mess that includes a personhood measure, defining a fetus as a person “from the moment of conception.” Prenatal murder, punishable as a felony, is defined as “the intentional removal of a fetus from a woman with an intention other than to produce a live birth or to remove a dead fetus…”
Women suffering from a miscarriage in which “human involvement” occurs is also defined as prenatal homicide.
Miscarriages with no “human involvement” are still suspect and should be investigated. A fetal death certificate, as well as a “report of spontaneous fetal death” must be filed within 72 hours.
Of course, since Roe v. Wade, abortion procedures have been legal. But Franklin gets around that inconvenient fact, with a bizarre state’s rights and nullification screed, concluding Roe v. Wade “carries no legal effect in Georgia.”
Franklin also introduced a recent bill that would change the status of rape victims to “accuser,” from “victim” in criminal statues.
