Brazilian Chief Supreme Court Judge Awards Goldman Custody of Son

(ChattahBox)—David Goldman’s emotional five-year international battle to be reunited with his son may finally be coming to an end. On Tuesday, the chief justice of the Brazilian high court ordered in a strongly worded 30-page decision that Goldman should be immediately reunited with his son Sean, who is now 9-years-old. It’s not known if the mother’s family would appeal, but a ruling from the chief justice of the country’s supreme court, would seem to be the final word in the matter after years of court battles.
Goldman won’t rest until his son is in his arms and on a plane bound for the United States. Just last week, a Brazilian federal court ruled that his son Sean should be handed over to the US consulate in Rio de Janeiro within 48 hours. Goldman few to Brazil from his home in New Jersey to finally take his son home, but his hopes were soon crushed when a Brazilian Supreme Court judge granted a habeas corpus request, blocking the lower court’s decision. The Judge ruled that Sean’s wishes should be heard by the court.
Goldman has been fighting for custody of his son, since his wife Bruna Bianchi Carneiro Ribeiro took Sean on a vacation to her homeland of Brazil in 2004 and never returned. She filed for divorce in Brazil and eventually married, João Paulo Lins e Silva, a prominent attorney in Brazil. But she died last year during childbirth. And Ribeiro’s family and her second husband have been fighting to keep Goldman from taking his son home. Goldman refers to the family, as Sean’s kidnappers.
Brazil and the US are both signatories to the Hague treaty, which mandates the return of abducted children. But the Brazilian courts have refused to grant Goldman legal custody of his son.
After five long years, fighting with the Brazilian courts and his former wife’s family to take his son home, Goldman may finally be reunited with Sean in time for Christmas. Goldman never gave up on his son. He wrote on his blog: “I have never lost hope the day would come for us to be together again. I will never give up, but I need help.”
