Back in March 2007, Fiola was let go and fired from his job with the state at the Department of Industrial Accidents (DIA).

Investigators found that his computer was using 4-times the data usage as other co-workers, and child porn was found on his computer.

He was charged in August, but forensics experts have found that he never actually downloaded the content.

His computer was infected with malware, which caused the problems.

The charges have now been dropped.

The District Attorney’s office is now being blamed for not doing the forensics test first.
