NY State Sen. Hiram Monserrate: Not Guilty of Felony Assault, Guilty of Misdemeanor

(ChattahBox)—New York State Senator Hiram Monserrate was found not guilty on two counts of felony assault yesterday and was instead, found guilty of a lesser misdemeanor count, paving the way for the lawmaker to retain his senatorial seat.

The Democratic lawmaker from Queens was arrested for slashing his girlfriend Karla Giraldo in the face with a broken glass in December 2008. He was charged with two counts of felony assault and a lesser misdemeanor charge of third-degree assault.

The misdemeanor assault charge stemmed from Monserrate’s dragging his bleeding girlfriend down the hallway of their apartment building, after her face was slashed.

Monserrate claimed that his girlfriend first attacked him and he was defending himself. But since that initial statement, the lawmaker clammed up and stopped cooperating with the prosecution in the case.
