Mexico Decriminalizes Small Amounts of Drugs for “Personal Use”

(ChattahBox)—Mexico announced on Friday, that the beleaguered country in the midst of a war against the country’s violent drug cartels, is decriminalizing the possession of small amounts of drugs. President Felipe Calderon is setting the stage to reserve police resources for his crackdown on violent drug traffickers and to reduce the police corruption that often occurs with the arrest of small-time drug users and addicts.

The new law sets strict limits on the amount of drugs that can be possessed to avoid a criminal penalty. People caught with small amounts of drugs would also be encouraged to seek treatment for drug abuse.

Bernardo Espino del Castillo of the attorney general’s office notes that in practice, most drug users caught with small amounts of drugs were not prosecuted, even though the law required long jail sentences. Addicts caught possessing small quantities of drugs were often not prosecuted, if they were able to pay off the police with bribes.

“The bad thing was that it was left up to the discretion of the detective, and it could open the door to corruption or extortion,” said Castillo.

Under the new “personal use” provisions, people can possess up to 5 grams of marijuana, a half gram of cocaine, 50 milligrams of heroin, 40 milligrams of methamphetamine and 0.015 milligrams of LSD.

After a person is caught a third time possessing small quantities of drugs for personal use, drug treatment is mandatory.
